Oyster Memories takes its’ Site users and customers’ (“you” or “your”) privacy seriously. This policy describes the information we ask for and how Oyster Memories treats your information.

We collect personal data from you via the Site, when you place an order we need your personal information (which we may from time to time ) such as name, mailing address, telephone and fax numbers, photographs, digital content, e-mail address, billing and financial information, credit or debit card information and other contact details of receiver

If you give your permission, Oyster Memories will occasionally use the information provided by you for marketing purposes. Examples: announcing software updates, special offers, and information about new products and services.

 Where necessary we will exchange the information with companies which help us provide our service, and then only for the defined purpose, or in the event of the sale, proposed sale or change of ownership of the company

Except to meet statutory obligations and for the reasons defined in this policy, we will never provide your details to a third party without your express permission. 

Oyster Memories will take all reasonable precautions to prevent the loss, abuse or change of the information provided by you. Our business partners who have access to your information have a duty of confidentiality and may not use this information for any purpose other than those defined in this policy.

If we wish to use your personal data for a new purpose, other than for which it was originally supplied in accordance with the above purpose specification, we will obtain your permission first. We understand that you trust us with your personal data and we take this trust very seriously.

Sensitive Personal Data We will never collect sensitive personal data about you (including, for example, medical information, criminal record and private life) without your explicit consent.

General terms and conditions

1. Order acceptance : All orders are accepted and handled in accordance with the conditions belowAfter fulfilling the order, the file provided by the customer will be stored on the Oyster Memories server for three months. This is to enable the customer to order further copies of the album at a later stage

2. Copyright : The customer is responsible for the contents of the submitted file. Oyster Memories does not accept responsibility for the contents of the file. Oyster Memories assumes that the copyright in the file is held by the customer. The customer bears sole responsibility for unauthorized use of protected data. When ordering and, where relevant, distributing the printed products the customer shall strictly observe the laws of the relevant country. The OysMem work which is the content & photo designing is completely owned by Oyster Memories and cannot be used for any other personal or commercial purposes by the customer. Any such action is strictly prohibited.

3. Liability : Oyster Memories shall not accept liability for damage or loss of the files. Oyster Memories emphasises that the quality of the prints in the albums ordered will never be better than is to be expected on the basis of what the customer sees on his/her computer monitor. Oyster Memories liability is limited to production errors attributable to it.

4. Delivery time & Cancellations

All orders are completed within 15 working days. Delayed delivery shall never be a reason for cancellation of the order or compensation.

The orders cannot be cancelled after the payment is made.

5. Guarantee: Any justified complaints shall be made within four weeks of the delivery of the materials ordered by the customer. If the complaint is justified the remedy shall be limited to producing the ordered materials again.

Oyster Memories only supplies the highest quality photo books. That is the reason why there is great customer satisfaction to our products. Oyster Memories understands your wishes: treasuring beautiful memories in an exquisite photo book. And that is all that counts! Also your experiences will be saved forever.

 It might be possible that the result does not live up to your expectations. You have the option of returning the photo book. You will get a refund or the product will be produced once again. Obviously, this will be determined in consultation with the customer service department. Oyster Memories employees are ready and at your service.

6. Disclosures: We will not disclose your personal data to other organizations, institutions or authorities unless required by law or with your consent.  We will not sell, rent or lease your personal data to others.  Sometimes we may need to give your personal data to our agents and/or sub-contractors for the purpose of processing you’re use of  Oyster Memories services, and you hereby consent to such limited disclosure.  You agree that if we transfer ownership or management of the Site or our business to a third party we may also disclose and transfer your personal data to such third party, provided such third party agrees to observe this Privacy Policy.

7. Fraud Prevention and Detection: Payments for Oyster Memories services may be made by you to us via the Site. We have systems that protect us and our customers against fraud. Accordingly, we may disclose your credit or debit card details to fraud prevention or other similar agencies. If you give us fraudulent or misleading information and we suspect fraud, we will make appropriate records. We may use and search public records to help us check your identity to prevent fraud.

8. Access : The Site is intended for access and use by persons in India only. Whilst the Site may be accessed and used by persons outside India, we do not represent or warrant that the information on this Site or any service provided through this Site complies with the regulatory regime of any other country. If you access and use this Site and/or any service provided via the Site from locations outside India you do so on your own initiative and risk and you are responsible for compliance with local laws.

9. Site Use : You are permitted to view, print out and/or download one copy of the materials or content/software on the Site on any single personal computer or similar equipment for your own personal, non-commercial use, provided that any notices, trade marks, logos and other brand materials that appear on the copied screens remain on them, and are not removed. You are permitted only to use such copies for information or for the purpose of using the Oyster Memories photo-book service or other service provided via the Site. This permission is subject to the material being reproduced accurately and not used in a misleading context and does not extend to any material on the Site that is identified as being owned by a third party. You may not modify any materials on the Site in any way or reproduce or use them for any public purpose. Where you wish to use any content or material on the Site for any purpose other than that permitted above, you must obtain our prior written consent. You will not copy, sell, rent, lease, license, sub-license, grant any rights in, transfer, distribute, time-share or otherwise assign to any third party any part of the Site. If you breach any of these terms, your authorisation to use this Site automatically terminates and you must immediately destroy any downloaded or copied materials.
